Terms and Conditions

These Terms and Conditions govern use of our website and purchases of parts and restoration services from Second Gen Graveyard, doing business as Second Gen Graveyard ("we," "us," or "our"). Please read them before placing an order. Our Privacy Policy explains how we handle personal information.

1 Agreement and eligibility

By placing an order after being presented with these Terms and accepting them at checkout or in an order agreement, you agree to these Terms. You must be at least 18 or the age of legal majority where you live and authorized to use your payment method. If you order for a business, you represent that you may bind that business. Mandatory consumer rights remain in effect.

2 Products and descriptions

We sell classic automotive parts, including used original equipment manufacturer (OEM), new reproduction, and new old stock (NOS) items. Product condition is described in each listing. Used parts may show age, wear, previous repairs, or cosmetic imperfections. NOS means older stock that has not been installed; it does not mean recently manufactured or free from storage-related aging. Reproduction parts may differ from original parts in material, texture, finish, or fit.

Read the complete listing and ask questions before ordering. Photographs may show a representative item unless the listing identifies the specific item pictured. We aim to describe products accurately. These Terms do not excuse an incorrect description or eliminate remedies required by law.

3 Fitment and installation

Before ordering, verify your vehicle year, model, options, measurements, and part numbers. Prior repairs and modifications can affect fit. Contact us if compatibility is uncertain. Inspect and test-fit parts before painting, modifying, or permanently installing them. Safety-related work should be performed by a qualified automotive professional. Follow manufacturer instructions and applicable vehicle, safety, and emissions requirements. Nothing here shifts responsibility for our own misdescription or a defective product where the law provides a remedy.

4 Prices payment and order acceptance

Prices are in U.S. dollars unless stated otherwise. Taxes, shipping, freight, and other agreed charges will be disclosed before you authorize payment. Some listings include shipping only within the contiguous United States; additional destinations require a quote. We will obtain your approval before adding charges that were not authorized with your order.

An automated order acknowledgment confirms receipt and does not guarantee inventory availability. We may decline an order for unavailable stock, a material pricing error, suspected fraud, or shipping restrictions. If a correction changes your total or the item ordered, we will ask you to approve it or cancel and receive a refund. If we cancel a paid order, we will refund the canceled portion promptly as required by law.

5 Shipping pickup and delays

Available shipping methods, charges, and estimated shipment dates depend on the item and destination. Oversized items may require freight service or a separate quote. Contact us before ordering for international delivery or special handling. We will disclose known customs or import charges that we collect; destination authorities may separately assess duties and taxes.

We will provide a reasonable shipment estimate. If no shipment period is stated for merchandise, we will comply with the applicable federal default shipping requirement. If we cannot ship within the promised or legally required period, we will provide the required delay notice, seek your consent where required, and offer cancellation and a prompt refund for unshipped merchandise. A custom-order designation does not remove these rights. Carrier transit estimates are separate from our shipment commitment.

Inspect deliveries promptly. Report missing, incorrect, or damaged items to secondgengraveyard@yahoo.com with your order number, photographs, and packaging details. Keep the packaging while a claim is being reviewed. Prompt reporting helps us resolve problems and meet carrier deadlines; it does not shorten rights that cannot legally be waived. We will work with you on carrier claims. Delivery responsibility is determined by the order agreement and applicable law, not automatically transferred to you when we hand an item to a carrier.

6 Returns and refunds

Our published policy states that sales are final after 30 days and returned items are subject to a 20% restocking fee. Contact us before shipping a return so we can confirm eligibility, the return address, and any authorization instructions.

Any exclusions or additional charges must be clearly disclosed before purchase. We will confirm the applicable refund and shipping arrangements when authorizing a return.

The restocking fee and final-sale language do not override remedies for defective, damaged, misdescribed, or incorrectly supplied goods that applicable law requires. Where law requires a full refund or prohibits a fee, that requirement controls. Manufacturer warranty claims and nonwaivable statutory rights are not cut off by the ordinary return window. Approved refunds are issued to the original payment method unless another lawful method is agreed.

7 Cancellations and restoration services

Contact us as soon as possible to request cancellation or an order change. Orders already shipped may need to follow the return process. Before custom production or restoration begins, we will confirm the scope, price, estimated completion time, customer preparation requirements, and any deposit, cancellation, or return restrictions in writing. We will obtain approval before charging for additional work outside the agreed scope.

For customer-supplied parts, document their condition before shipment and use appropriate packaging. We will provide shipping instructions and identify any third-party restoration provider involved in the service. The agreed service scope determines which defects are repaired and which original components are reused. Color, grain, and finish expectations should be agreed before work begins. Any storage fees, core charges, or unclaimed-property procedures require a separate lawful disclosure; these Terms alone do not authorize them.

8 Warranties

Any applicable written warranty and legally required product remedies remain in effect. Contact us to determine whether a particular new product carries a manufacturer warranty and how to make a claim. We do not promise that a manufacturer will accept a particular claim.

These Terms do not by themselves designate every product as sold "as is" or disclaim implied warranties. Any proposed disclaimer must be reviewed for the particular product, disclosed conspicuously before sale where permitted, and consistent with any written warranty and applicable law.

9 Liability and consumer rights

To the extent permitted by law, we are not responsible for indirect or consequential losses such as lost profits or loss of vehicle use arising from an order or use of the website. This exclusion does not apply to fraud, willful misconduct, gross negligence, liability for personal injury or property damage caused by a defective product where exclusion is prohibited, or any other liability that law does not allow us to exclude. We do not limit rights under an applicable written warranty or mandatory consumer law. Some jurisdictions do not allow certain exclusions, so those exclusions may not apply to you.

10 Website content and permitted use

Website photographs, text, logos, and other original materials belong to us or their respective owners. You may use the site for lawful personal shopping and reference. Do not copy or commercially reuse protected materials without permission, interfere with site operations, bypass security controls, submit malicious code, impersonate another person, or use information obtained from the site for unlawful purposes. Third-party trademarks identify their owners and do not by themselves imply affiliation or endorsement.

11 Customer photographs and stories

If you choose to submit photographs or a vehicle story for our Customer Rides feature, we will obtain your permission before publishing the submission. The permission should identify the approved content, display name, and uses. You retain ownership of your material and must have permission from other rights holders and identifiable people. Sending a private order inquiry does not grant permission to use it in advertising. Contact us to request removal of content we control; we cannot retrieve independent third-party copies.

12 External services and privacy

The website may link to other sites or use outside providers for functions such as checkout, hosting, and communications. Their separate terms may apply to their services. We remain responsible for our own obligations to you. Our Privacy Policy describes the information practices of this business; an external link does not make another company subject to our policy.

13 Disputes changes and contact

Please contact us first so we can try to resolve a concern. Tennessee law governs these Terms to the extent permitted by applicable conflict-of-law and mandatory consumer protection rules. Nothing here requires arbitration, waives a jury trial or class action, or prevents a claim in a court available under applicable law.

We may update these Terms by posting a new effective date. Updates apply prospectively and do not change an existing order unless you agree or law requires it. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
